CASP Crypto License in Netherlands
As the EU enforces the Markets in Crypto-Assets (MiCA) Regulation, the Netherlands stands out as one of the few Member States already granting CASP licenses. With an experienced regulator (AFM), a crypto-friendly legal system, and a fast-track transition window, the Netherlands offers a strong, credible route to EU-wide market access.
Why the Netherlands?
With its established fintech sector and pragmatic regulatory environment, the Netherlands offers:
• A proactive regulator — the Netherlands Authority for the Financial Markets (AFM)
• Full EU passporting rights
• One of the first EU countries to issue MiCA licenses
• Six-month transition regime ending June 30, 2025
• Strong tech and financial infrastructure
• Transparent AML/KYC and market abuse framework
MiCA License Classes
Under MiCA, licensing depends on the services you offer:
• Class 1 — Advisory, order execution, portfolio management (min. €50,000 capital)
• Class 2 — Custody and brokerage services (min. €125,000 capital)
• Class 3 — Crypto trading platforms and multilateral systems (min. €150,000 capital)
Banks, investment firms, and other regulated entities may qualify for an Article 60 exemption, allowing a simplified notification instead of a full license.
Application Timeline (Approx. 4–7 Months)
The AFM supports both full license applications and Article 60 notifications. It also offers a pre-scan option for early feedback.
EU Passporting
Once licensed, you can operate in any EU country via a simple notification.
Service rollout in new markets begins 15 calendar days after notifying the AFM.
Transition for Registered CASPs
Companies already registered with the Dutch Central Bank (DNB) before MiCA’s effective date (December 30, 2024) can:
• Continue operating in the Netherlands until June 30, 2025
• Apply for a MiCA license during this six-month transition period
• Benefit from continuity of services while preparing documentation
However, passporting rights across the EU begin only after a MiCA license is issued.
